This paper aims to investigate the current state of play on Environmental Social and Governance (ESG) integration and check the validity of the current metrics system by assessing if it will survive the COVID-19 crisis. By adopting a qualitative research approach through semi-structured anonymous interviews with 14 senior managers of six European listed companies we use a framework by assessing the mechanisms of reactivity on the effectiveness of ESG measures in times of COVID-19. By interpreting the practitioners’ points of view (...) through the lens of the sociological framework by Espeland and Sauder (Am J Sociol 113:1–40, 2007) our findings show different mechanisms of reactivity by companies on the effectiveness of ESG measures in times of COVID-19, i.e., active and passive conformity and active resistance. We also identified the main Corporate Social Responsibility (CSR) institutional factors that affect managers’ reactivity. An extensive re-formulation of the ESG metrics is required in the light of times of crisis, given that accountability and transparency are strongly linked to quantitative measures which can play a critical role in the financial system and investors’ engagement. Particularly, the strict distinction between “E”, “S” and “G” issues should be abandoned claiming a different holistic re-design of sustainability measures by considering the increasing relevance of the Social dimension in time of COVID-19. This study provides a valuable contribution to the existing literature on the measurement of sustainability within the link of accountability and crisis by highlighting new corporate needs to re-design the ESG metrics system. With the advent of the cloud computing model allowing a shared access to massive computing facilities, a surging demand emerges for the protection of the intellectual property tied to the programs executed on these uncontrolled systems. If novel paradigm as confidential computing aims at protecting the data manipulated during the execution, obfuscating techniques (in particular at the source code level) remain a popular solution to conceal the purpose of a program or its logic without altering its functionality, thus preventing reverse-engineering (...) on the program even with the help of computing resources. The many advantages of code obfuscation, together with its low cost, makes it a popular technique. This paper proposes a novel methodology for source code obfuscation that can be used together with other traditional obfuscation techniques, making the code more robust against reverse engineering attacks. Three program complexity metrics are used to define three different single-objective combinatorial optimization versions of the problem, which are solved and analysed. Additionally, three multi-objective problems are defined, those considering each of the selected metrics together with the program execution time, in order to avoid strong obfuscations penalizing the performance. The goal of the defined problems is to find sequences of LLVM optimizations that lead to highly obfuscated versions of the original code. These transformations are applied to the back-end pseudo-assembly code (i.e., LLVM Intermediate Representation), thus avoiding any further optimizations by the compiler. Classical genetic algorithms (GAs) are used to solve the studied problems, namely a basic cellular GA for the single-objective problems and the popular NSGA-II for the multi-objective ones. After the Maastricht and Amsterdam Conferences the European Union can no longer be conceived as an intergovernmental arrangement: It is a polity founded on an “overlapping consensus.” Consequently, to reconstruct the relations between national and Community law, legal monism does not work, neither in its statist, nor in its international version: Legal pluralism is needed, not in a sociological‐descriptive sense, but as a normative criterion by which a judge (and a citizen) must refer to many and various sources of law (...) to settle a dispute. Legal pluralism, however, can operate only under a rule of recognition: a common normative framework within which a reasonable number of sources can be handled. What Europe needs, therefore, is an interactionist constitution, which should emerge through an “open‐ended”discursive process. (shrink)

In cybersecurity, there is a call for adaptive, accurate and efficient procedures to identifying performance shortcomings and security breaches. The increasing complexity of both Internet services and traffic determines a scenario that in many cases impedes the proper deployment of intrusion detection and prevention systems. Although it is a common practice to monitor network and applications activity, there is not a general methodology to codify and interpret the recorded events. Moreover, this lack of methodology somehow erodes the possibility of diagnosing (...) whether event detection and recording is adequately performed. As a result, there is an urge to construct general codification and classification procedures to be applied on any type of security event in any activity log. This work is focused on defining such a method using the so-called normalized compression distance (NCD). NCD is parameter-free and can be applied to determine the distance between events expressed using strings. As a first step in the concretion of a methodology for the integral interpretation of security events, this work is devoted to the characterization of web logs. On the grounds of the NCD, we propose an anomaly-based procedure for identifying web attacks from web logs. Given a web query as stored in a security log, a NCD-based feature vector is created and classified using a support vector machine. The method is tested using the CSIC-2010 data set, and the results are analyzed with respect to similar proposals. (shrink)

This article provides an assessment of the merits of recent theories of legal reasoning. After a quick historical aperçu a number of models of legal argumentation are presented and discussed, with an eye to their mutual connection. An initial conclusion is that universalizability and discursivity are the common features of those models. The focal question dealt with, however, is that of the impact of the argumentative paradigms of adjudication on the very concept of law. Here the contention is that an (...) argumentative style of reasoning contributes to rendering the structure of the law itself and its operations argumentative as well. By so doing the latter are—so to say—civilized and made less truculent. They will thus be able to develop more in conformity with a democratic form of life. (shrink)

A partir del comentario hecho por José L. L. Aranguren sobre «puede» y «debe» en ética, aquí se plantea el significado de los principios de ética en la situación de retroceso democrático del siglo XXI. Ha sido analizada por la filosofía y la teoría política recientes. En los años sesenta, las críticas de D. Sternberger al modelo de polis, de política cívica en las obras de H. Arendt, se apoyaban en la imagen de la ciudad hundida. Pero las preguntas sobre (...) el alcance del realismo («puede») y el lugar de los principios («debe») siguen abiertas. ¿Ultra posse nemo obligatur? Aquella imagen de la polis puede ser reemplazada por otra algo distinta, la ciudad sumergida. Se encuentra en la literatura, sería también la metáfora de la necesaria reconstrucción de las políticas democráticas, con el «deber ser» como núcleo de la cultura cívica. Los principios éticos y, en especial, justicia como equidad será aquí la referencia en dos situaciones: (1) la política de salud pública, (2) los procesos de paz. En conclusión, el marco normativo cuenta o ha de contar, tanto en la paz como en la guerra. Decir «nunca más» es también una forma de recordar el papel crucial de los principios. (shrink)

Se presenta la traducción de un trabajo redactado por W. V. O. Quine para la asignatura sobre Psicología avanzada, impartida por el profesor John Beebe-Center en Harvard. Se trata de un texto inédito que Quine entregó en la primavera de 1931. En este escrito se demuestra un conocimiento exhaustivo del estado de la entonces joven disciplina psicológica, de sus nombres más relevantes y de sus escuelas más sobresalientes en la época. El primer y último apartados contienen elementos de interés historiográfico (...) y filosófico para los expertos e interesados en el pensamiento de Quine. Los apartados segundo y tercero muestran el dominio de la materia desde distintos puntos de vista diferentes, a saber: la óptica, la fisiología ocular, la psicología de la percepción y, por supuesto, la historia de la filosofía que subyace a los planteamientos de las distintas escuelas psicológicas. Se presenta acompañado de una introducción que vincula las ideas que aparecen en este trabajo con cuestiones relevantes en la actualidad para la Filosofía de la Psicología y la Neurociencia computacional en su debate con el Naturalismo. Este artículo pretende exponer la complejidad del tema del estatuto del embrión en la fase de preimplantación. Para ello, se exponen de modo sistemático las diferentes razones que sustentan tanto la postura de la anidación como de la fecundación. Estas razones son tan fundantes que obligan a seguir manteniendo un diálogo abierto y no sustentar posturas cerradas.

ABSTRACT: After World War Two a gigantic effort was made in order to build a viable and stable international order, beginning with the Bretton Woods agreement that was aimed to stabilize the international monetary system, and with the United Nations, that were intended to restore legality in interstate affairs and somehow initiate a cosmopolitan conversation among Nation States. This order is now slowly crumbling down, paradoxically through globalization, and a triumphant neoliberalism. This is an attempt to conceptualize freedom beyond the now traditional opposition beetween a negative and a positive notion. To this purpose several weaknesses of the idea of negative freedom are pointed out and taken into account, while positive freedom is reinterpreted in terms of a social capacity, without reference however to romantic self-affirmation. Freeedom is thus seen connected with the question of power and authority, whose main theories are then shortly assessed. Among these the so-called „service conception“ is the (...) object of a more detailed discussion. The outcome will be a proposal to make it possible to understand freedom as a special enabling position with regard to authority. (shrink)

A permanent approach to what law is has been that of interpreting it in terms of repression or reduction of chances or courses of conduct. This approach, however, is not able to render justice to fundamental moments of the legal practice, beginning with constitutional law and its empowering rules. Nonetheless, the mainstream in the philosophy of law and in the legal theory has not at all been worried about this strange inadequacy of imperativism to offer a complete view of legal (...) practice and legal institutions. Force, violence, sanction, prescription still are the basic conceptual knots used to weave the cloth of law and lawyers. Hannah Arendt perceptive though scanty remarks on law, within her wider reflections on action and judgment, offer a different view and open a new path for a jurisprudence less obsessed with coercion, and against the tradition supporting the centrality of command in the tlegal domain. Such view and that path this paper tries sympathetically to explore. (shrink)

My paper consists of four sections. The first is concerned with the distinction and connection between fundamental and human rights. Here I shall just introduce a few conceptual notions and definitions that are more or less widely used, but that may help us to frame the issue and better focus on the most relevant question of the foundation or justification of human rights. In the second and third sections I will present what I believe to be the four fundamental normative (...) situations that shape our understanding and use of human rights. In the second section attention will focus on what in my opinion is the most basic of these four normative situations, which I call the “existential” situation. This is intended to offer a strong foundation for human rights as “not metaphysical,” without appealing to or relying on heavy metaphysical assumptions. I will try to stick more or less to an argumentative strategy based on common sense. The third section, dealing with the three other normative situations, will to some extent be an exercise in eclecticism, trying to combine different approaches to (and schools of thought on) the question of normativity. Here eclecticism will not be trivial, or at least I hope not. In the fourth and final section I will briefly conclude with a general overview on the issue of the “existence” of normativity and human rights. (shrink)

There are few problems to which legal philosophers have devoted more attention than the relationship between morality and law, or, said in different terms, between the “good” and the “obligatory”. One might think that all that should and could be said about it has already been uttered or written. Nevertheless philosophy — and legal philosophy is no exception — is just this: rethinking old problems which are in fact always new,1 and for which no definitive solution is given — nor (...) is possible, I would add — and which need a permanent effort of reassessment. This paper discusses some models purported to legitimise a European supranational legal order. In particular, the author focuses on an application of the so‐called regulatory model to the complex structure of the European Community and the European Union. First of all, he tackles the very concept of legitimacy, contrasting it with both efficacy and efficiency. Secondly, he summarises the most prominent positions in the long‐standing debate on the sources of legitimation for the European Community. Thirdly, in this perspective, he analyses (...) several, sometimes contradictory, notions of the rule of law. His contention is that we can single out five fundamental notions of the rule of law and that some but not all of them are incompatible with or oppose democracy. Finally, the paper addresses the regulatory model as a possible application of the rule of the law to the European supranational order. The conclusion is that the regulatory model should be rejected if it is presented as an alternative to classical democratic thought, though it might be fruitful if reshaped differently and no longer assessed from a functionalist standpoint of deliberation. El presente volumen está dedicado a la reflexión filosófica inter-cultural y, por ello, con nombre propio, a Raúl Fornet-Betancourt, figura prominente en este ámbito del pensar contemporáneo en Latinoamérica, El Caribe y Europa. Es en gran parte gracias al Prof. Fornet-Betancourt que la voz de los pueblos hispanohablantes de América es escuchada actualmente como expresión de un modo de pensar propio que, sin abandonar el profundo y amplio conocimiento de la tradición, asume nuevas problemáticas y objetos de reflexión, como también (...) permanentes y antiguos dilemas de la existencia hu-mana, desde una perspectiva de diálogo entre culturas. Esta perspec-tiva, abierta a la sensibilidad creativa de la rica mixtura afrodescen-diente, indígena y europea que configura el amplio ethos espiritual de Centroamérica, el Caribe y América Latina, habla al mundo desde lo propio que no se encierra en sus límites, sino que, por el contrario, se atreve en igualdad de condiciones a entrar en diálogo con otras culturas en torno a lo sido del mundo, del hoy que nos compete y de lo que adviene desde ya en el presente. Este es el legado que ya desde hace algunos años construye el Prof. Fornet-Betancourt, y que sirve de marco de referencia a la mayoría de artículos que conforman este número especial de nuestra revista en su honor. Este artículo aborda la ‘tierra natal’ como expresión de la pregunta heideggeriana por ‘el sentido de lo que es’. Técnica y civilización mundial son consideradas aquí como tendencias hacia la homogenización de la experiencia humana y como pérdida de ‘lo propio’ representado en la tierra natal, lo que conduce a la disolución de la diferencia y de la interpelación ética del Otro. La filosofía de Heidegger, por el contrario, permite afirmar la tierra natal como apertura a la interpelación del ‘otro’.

En este trabajo argumentaré primero que para entender las relaciones entre el populismo la democratización y el autoritarismo hay que partir de las experiencias latinoamericanas donde los populismos han retado al poder y han gobernado desde los años 40. Los científicos sociales latinoamericanos teorizaron y debatieron sobre el populismo desde que Gino Germani escribió en los años 50 sobre el peronismo y los investigadores europeos y norteamericanos deberían tomar en serio la larga y compleja bibliografía latinoamericana sobre el tema. Además, (...) Latinoamérica es la región en la que se han dado los populismos más benignos e incluyentes, mientras que las caras más autoritarias del populismo de derecha se han manifestado en los Estados Unidos y en algunos países de Europa. Mi segundo argumento es que hay que diferenciar las críticas populistas al poder constituido que señalan los déficits de participación y representación de las democracias de sus soluciones que reducen la complejidad de la democracia, la sociedad civil y la esfera pública a la lucha entre dos campos antagónicos. Mi tercer argumento es que hay que diferenciar entre inclusión y democratización. Los populismos latinoamericanos, desde el peronismo hasta el chavismo, han incluido políticamente, étnicamente y socio-económicamente a los sectores marginados. Sin embargo a su vez han atentado en contra del pluralismo, han manufacturado enemigos y han cerrado espacios a la oposición. Mi cuarto argumento es que si bien los populismos comparten una lógica política no todos son iguales. Algunos politizan las exclusiones alrededor del eje mercado-estado, otros alrededor de temas culturales como la identidad del pueblo y la nación. Unos usan criterios étnicos para construir al pueblo, mientras que otros politizan las exclusiones socioeconómicas. (shrink)

Law seems to be irremediadibly connected to the experience of coercion and to a structure of hierarchy. This is so because it has traditionally been defined as a set of authoritative prescriptions, usually commands backed by the menace of a sanction, an evil eventually applied through the use of overwhelming violence. Law has also been related to some kind of structure or system which is intrinsically hierarchical, both in the sense of the hierarchy of people whose conduct is addressed by (...) the law and in the sense of the logical interdependence of the legal prescriptions themselves. The British legal philosopher H. L. A. Hart criticizes in his celabrated book The Concept of Law powerfully the command theory and also reshapes the theory of the hierarchical structure of rules. The paper will tries to follow Hart’s attack to the traditional imperativistic view and will then focus on his treatment of international law. The aim is to show on the one side how promising Hart’s approach could be, and on the other side how poor however his conceptualization of international law at the end of the day reveals to be. Le droit est traditionnellement lié à la pratique du commandement et de la hiérarchie. Il semble qu’une règle juridique établisse une immédiate relation entre une norme supérieure et une norme inférieure. La conception hiérarchique et impérative peut néanmoins être remise en cause dès lors que la phénoménologie de la règle juridique est appréhendée d’un point de vue interne, celui de ceux que l’on peut considérer comme les « utilisateurs » de la règle plutôt que ceux qui la subissent. Une approche (...) tournée vers la pratique pourrait, de cette façon, conduire à une théorie du droit plus ouverte et, d’une certaine façon, moins idéologique ou sectaire. C’est – comme le défend cet article – le programme ou mieux la promesse que l’on trouve dans l’ouvrage principal de Hart, le Concept de droit. Cet article tente de rendre cette promesse plus transparente sans toutefois dissimuler les difficultés de sa stratégie narrative et argumentative. (shrink)

El objetivo es conocer las circunstancias y tratamiento judicial de asesinatos por violencia de género. Se plantea el diagnóstico forense de muerte, se exponen resultados de la investigación realizada por Genovés et al. en 2018 sobre150 casos de muerte por violencia de género en Andalucía, se plantea un posible patrón de conducta basado en la teoría de los pensamientos obsesivos y rumia silenciosa. Los resultados muestran una violencia anunciada, sin trastornos mentales graves, los asesinatos se mantienen constantes en el tiempo, (...) la violencia empleada suele ser excesiva en comparación con otras muertes, el instrumento más usado es arma blanca, el agresor no se esconde, no suele arrepentirse, la calificación ha sido de asesinato en un 79%, concurriendo alevosía en un 91% de los casos, la indefensión de la víctima es buscada y utilizada por el agresor, el domicilio familiar es el lugar donde más asesinatos se producen. Se aprecia una evolución positiva en la aplicación del derecho. Es necesaria la perspectiva de género en la Justicia. (shrink)

Este trabajo parte de la concepción de la narrativa transmedia por parte de Henry Jenkins como el arte de making worlds, de construir mundos de ficción, para extender los fundamentos teóricos de esta definición al género documental. Si Bill Nichols indica que este género de no ficción tiene per se un gran poder persuasivo -por la naturaleza icónica de sus imágenes y sonidos y por el efecto psicológico de verosimilitud que suscita en el público-, aquí defendemos que este carácter se (...) potencia por medio de la narrativa transmedia. La inmersión, la extrabilidad y la performatividad de este tipo de narrativa lleva a la participación activa del usuario en el mundo transmedia, que coincide con su propio mundo, el real. Por esa razón numerosos proyectos activistas han visto en el documental transmedia una oportunidad tanto para el ejercicio del pensamiento crítico como para el cambio social. (shrink)

Como tesis de este artículo se plantea que la filosofía heideggeriana posibilita meditar en torno a la experiencia del reconocimiento del otro. Después de poner en cuestión algunas de las críticas dirigidas a Heidegger debido a su énfasis sobre el ámbito ontológico, se aborda el sentido del concepto de reconocimiento y su nexo con la noción de cercanía, para culminar en la identificación de la cercanía con el lenguaje. Esta identificación dará a la experiencia del reconocimiento un carácter particular (óntico- (...) ontológico), que permitirá comprender su “esencia”. La pregunta por la condición de posibilidad del reconocimiento conducirá al concepto de “pre-sentimiento”, no abordado por Heidegger pero posibilitado por su filosofar. Se concluye con la concepción del reconocimiento como condición estructural de la existencia humana. (shrink)

The uncritical appropriation of Eurocentric ethical paradigms can be detrimental to disenfranchised communities of color, especially the Hispanic community. This essay argues for an ethical methodology rooted in the hopelessness found within Latino/a marginalized communities. Advocating for an ethics para joder disrupts a normative Eurocentric ethical discourse that at times normalizes and legitimizes "empire." The essay begins by casting a critical gaze at the academy before analyzing the overall social context in which Hispanics find themselves.
